Terms of Service

1. Agreement and Acceptance

These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and Decision Boundary LLC ("Company," "we," "us," or "our") regarding your use of the Sensor platform and related services (the "Service") available at https://sensor.decisionboundary.ai/.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Description of Service

Sensor is a cybersecurity data intelligence platform that provides:

• High-fidelity HTTP request and response captures
• Raw packet data (PCAP files) from global sensors
• Real-time streaming and batch data delivery
• Enriched metadata including ASN and geolocation data
• JA4+ signatures (available upon request)
• CVE-specific honeypot data (available upon request)

The Service is designed for security researchers, corporate research labs, and threat intelligence professionals conducting legitimate security research.

3. Account Registration and Requirements

3.1 Eligibility

To use the Service, you must:

• Be at least 18 years of age
• Have the authority to bind your organization (if applicable)
• Provide accurate and complete registration information
• Comply with all applicable laws and regulations

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Immediately notifying us of any unauthorized use or security breach
• Using strong passwords and enabling two-factor authentication when available

4. Acceptable Use Policy

4.1 Permitted Uses

You may use the Service and Data for:

• Legitimate security research and analysis
• Threat intelligence and incident response
• Academic research and educational purposes
• Development of security tools and methodologies
• Compliance with your organization's security obligations

4.2 Prohibited Uses

You may NOT use the Service or Data to:

• Resell, redistribute, or sublicense unaggregated raw data to third parties
• Conduct unauthorized access attempts or attacks against third-party systems
• Violate any applicable laws, regulations, or third-party rights
• Reverse engineer, decompile, or attempt to derive our proprietary methods
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any illegal, harmful, or malicious purpose
• Exceed rate limits or attempt to circumvent technical restrictions

4.3 Research and Ethics

You agree to:

• Conduct research in accordance with ethical guidelines and best practices
• Respect the privacy and rights of individuals whose data may be incidentally captured
• Use the Data solely for defensive security purposes
• Implement appropriate safeguards when handling sensitive information

5. Data Rights and Restrictions

5.1 Data Ownership

• Company retains all rights to the collected data, metadata, and data compilation methods
• You receive a limited, non-exclusive license to use the Data as permitted under these Terms
• You own any original analysis, reports, or insights you create using the Data

5.2 Data Usage Rights

Subject to these Terms, you may:

• Access, download, and analyze the Data for permitted purposes
• Create aggregated reports and statistics from the Data
• Share insights and analysis derived from the Data (without sharing raw data)
• Store and process the Data within your organization's secure environment

5.3 Data Restrictions

You may NOT:

• Share raw, unaggregated Data with third parties without express written consent

6. Service Availability and Support

6.1 Service Level

We strive to maintain 99.9% uptime for the Service, excluding:

• Scheduled maintenance windows (with advance notice)
• Force majeure events beyond our reasonable control
• Service disruptions caused by third-party infrastructure providers

6.2 Support

We provide:

• Technical documentation
• Email support for account and technical issues
• Best-effort response within 5 business days

6.3 Service Modifications

We reserve the right to:

• Modify, suspend, or discontinue any aspect of the Service
• Update data collection methodologies and sensor configurations
• Implement new features or technical requirements
• Provide reasonable advance notice of material changes when feasible

7. Subscription and Payment Terms

7.1 Subscription Plans

• The Service is offered on a subscription basis with monthly billing cycles
• Academic and non-profit discounts are available to qualified organizations that consistently maintain a payment history free of late payments
• JA4+ signatures entail additional monthly cost
• CVE-specific honeypots entail additional setup cost and monthly cost
• Other bespoke augmentations may entail additional setup cost and/or monthly cost

7.2 Payment Terms

• Payment is due in advance for each month
• All fees are non-refundable except as required by law
• Late payments may result in temporary, or permanent, revocation of subscription discounts
• Late payments may result in service suspension
• Price changes will be communicated with 30 days advance notice

7.3 Taxes

Customer is responsible for all applicable taxes, duties, and governmental charges related to the Service.

8. Intellectual Property

8.1 Company IP

We retain all rights to:

• The Service platform, software, and infrastructure
• Data collection methodologies and algorithms
• Trademarks, logos, and branding elements
• Proprietary data processing and enrichment techniques

8.2 Customer IP

You retain rights to:

• Your original analysis, reports, and research findings
• Any improvements or tools you develop independently
• Your organization's proprietary data and methodologies

8.3 Feedback

Any feedback, suggestions, or improvements you provide may be used by us without restriction or compensation.

9. Privacy and Data Protection

Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.

10. Warranties and Disclaimers

10.1 Service Warranty

We warrant that the Service will perform substantially in accordance with our published specifications under normal use conditions.

11. Limitation of Liability

11.1 Liability Cap

Our total liability to you for all claims arising from or related to the Service shall not exceed the total amount paid by you for the Service during the 12 months preceding the claim.

12. Indemnification

• Unauthorized access to the Service using your credentials
• Your combination of our Data with other information sources

13. Term and Termination

13.1 Term

These Terms remain in effect for the duration of your subscription and use of the Service.

13.2 Termination by Customer

You may terminate your subscription:

• At any time with 30 days written notice
• Without penalty at the end of your subscription period
• With immediate effect for material breach by us

13.3 Termination by Company

We may suspend your access:

• Immediately for late payment

We may terminate or suspend your access:

• Immediately for violation of these Terms
• With 30 days notice for non-payment
• With 90 days notice for business reasons

13.4 Effect of Termination

Upon termination:

• Your access to the Service will cease
• Outstanding payment obligations remain due
• Provisions that by nature should survive termination will remain in effect

14. Export Controls and Trade Compliance

The Service and Data may be subject to export control laws and regulations. You agree to:

• Comply with all applicable export control and trade sanction laws
• Not export, re-export, or transfer Data to prohibited countries or entities
• Obtain necessary licenses or authorizations for your use
• Immediately notify us of any compliance concerns or violations

15. Governing Law and Disputes

15.1 Governing Law

These Terms are governed by the laws of Oregon, United States, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes will be resolved in the state and federal courts of Oregon, and you consent to personal jurisdiction in those courts.

15.3 Dispute Resolution

Before filing any lawsuit, the parties agree to attempt good faith negotiations to resolve disputes. Disputes not resolved within 60 days may proceed to litigation.

16. General Provisions

16.1 Entire Agreement

These Terms, together with our Privacy Policy and any subscription agreements, constitute the entire agreement between you and us.

16.2 Modifications

We may modify these Terms by posting updates on our website and sending notice to your registered email address. Modifications take effect 30 days after notice.

16.3 Severability

If any provision is found unenforceable, the remainder of these Terms will remain in full force and effect.

16.4 Waiver

Our failure to enforce any provision does not constitute a waiver of that provision or any other rights.

16.5 Assignment

You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.

16.6 Force Majeure

Neither party will be liable for delays or failures due to circumstances beyond their reasonable control.
